John is an experienced commercial advocate, his practice encompassing a broad range of commercial, property and insolvency matters.

He is regularly instructed by Local Authorities, in particular his practice includes:

  • Advising and acting for Local Authorities in Liability Order proceedings for non-payment of Business Rates and Council Tax, including applications to set aside liability orders and appeals of Valuation Tribunal decisions.
  • Property and Landlord and Tenant matters for Councils
  • Enforcement of sums owed to Councils

Local Government & Social Housing Cases

Appeared on an appeal of a Valuation Tribunal Decision to the High Court.

Successfully acted for a Local Authority in defending an application to set aside Liability Orders for Business Rates.

Obtained Liability Orders for a Local Authority at trial in a case where it was argued that Liability Orders should be set aside as the Company named on the Lease for the Property was merely a holding company and could not be an occupier for the purpose of rating. Also acted in the parallel Insolvency Proceedings in the High Court. The Company was wound-up as a result of the Liability Orders.

Regularly advises Local Authorities as to whether to issue applications for Liability Orders and on matters of enforcement.

Advised upon and drafted possession proceedings in relation to the enforcement of a Local Land Charge.

Advised upon whether a Council was able to sell a property to a sports club.

Advised upon enforcement of sums due to a Council in relation to care provided by the Council on death, where no personal representatives of the deceased had been appointed.
