David Toal acts for GMC in Fitness to Practise Panel Hearing

David Toal from Exchange Chambers has acted for the General Medical Counsel in a Fitness to Practise Panel Hearing against Doctor Robert Lawton.

The Fitness to Practise Panel considered an allegation that in March 2011 Dr Lawton engaged in sexual conduct with Miss A without her consent and against her will.

A criminal investigation began in Scotland in January 2012 and Doctor Lawton was subsequently charged with rape almost two years following the alleged attack, forcing him to refer himself to the General Medical Council.

However, when the matter was referred to the Procurator Fiscal, it was decided that the allegations against him would not be taken forward.

Opening the hearing this week, David Toal said:

“The case for the GMC is it must have been perfectly clear to him that Miss A was not consenting to what he was doing but he simply carried on.”
