Successful planning law prosecution for David Birrell

David Birrell from Exchange Chambers has acted for West Lancashire Borough Council in a planning law prosecution at Preston Crown Court against defendants, Timothy and Susan Edwards.

Mr and Mrs Edwards were convicted of offences of Breaching an Enforcement Notice contrary to s.179 of the Town and Country Planning Act 1990.  They ran an illegal caravan park on their farm in Tarleton, West Lancashire for a period of 3 years and made substantial profits from their offending.  David Birrell advised West Lancashire Borough Council to instigate confiscation proceedings, with the Court imposing a confiscation order of £60,000 along with fines and costs orders totalling £10,000.

David, who specialises in bringing regulatory prosecutions on behalf of local authorities, was instructed by Kay Lovelady at West Lancashire Borough Council.
