Mark Cawson QC addresses Hong Kong General Chamber of Commerce

Mark Cawson QC has addressed the Hong Kong General Chamber of Commerce on Claims to Enforce Business Sale and Share Warranties – Some Practical Lessons.

It is increasingly common for warranties to be given on the sale of a business or a shareholding in a company.  This has resulted in a number of claims pursued through the courts, or by way of  expert determination to enforce these warranties.  In his seminar to the Hong Kong General Chamber of Commerce, Mark spoke on the function of warranties in these types of transactions, and some lessons to be learned from recent judicial decisions in the UK.  He also dwelled on expert determination as a way of resolving claims, as well as the remedies available.
