Ian Whitehurst secures acquittal for client charged with multiple serious offences

Ian Whitehurst from Exchange Chambers has secured not guilty verdicts on all counts for a man charged with multiple serious offences after a fatal road traffic accident.

The case involved an HGV and trailer being involved in a collision with another vehicle in 2019 on the A66 in North Yorkshire.

Complex forensic collision issues included construction evidence, engineering evidence, tachograph evidence and issues of disclosure and complex legal argument on the issue of aiding and abetting the offences. Three defence experts and three prosecution experts were involved.

In a two-handed case, charges included causing death by dangerous driving, causing serious injury by dangerous driving (life changing injuries) and dangerous driving.

Both Ian’s client, the front seat passenger, and the driver had no evidence offered against them today at York Crown Court (day 7 of the trial) after the main prosecution expert was cross examined.   They were therefore acquitted on all charges.
