Balfour Beatty Utility Solutions Limited fined £2.6m in case prosecuted by Adrian Farrow

May 6, 2016

HHJ Mark Brown, the Honorary Recorder of Preston imposed a fine of £2.6m and costs on part of the Balfour Beatty Group in relation to breaches of Health and Safety legislation in a case prosecuted by Adrian Farrow at Preston Crown Court on 5th May.

The case followed the death of a contractor who was crushed in a trench collapse in work to connect the offshore windfarm to the national grid at Heysham in April 2010.

The judge accepted the prosecution argument that ‎the February 2016 sentencing guidelines should apply even in light of the 6-year gap between the offences and the sentence.

Commenting afterwards, Adrian said: “This fine underlines the way that the Court is approaching penalties for large companies in Health and Safety cases under the new Guidelines.”

Adrian was instructed for the HSE by Holdens Solicitors.
