Success for Bill Hanbury in High Court Appeal

Bill Hanbury from Exchange Chambers has been successful in an appeal to the High Court against the decision of the County Court to dismiss his client’s claim for possession.

Bill Hanbury’s client, JS, sought possession as she claimed her son had merely a licence to occupy the property which she shared with him.

While the property was solely owned by JS, her son argued by reference to the doctrine of proprietary estoppel that she was estopped from asserting any right to possession as a result of conversations where he was told he could remain living in the property.

The High Court found in JS’s favour, allowing her claim for possession.
