Trees and the Law
A tree in the right place is a thing of beauty valued by all whose actual or threatened loss can provoke strong feelings: on the other hand a tree in the wrong place can cause physical damage, interfere with the enjoyment of land and buildings, provoke equally strong feelings and lead to heated disputes between those involved. Rachel Coyle and Peter Dixon will examine how the law deals with trees including the protection which it affords to trees of special value through the use of tree preservation orders (TPOs), how the TPO consent regime operates and the duty to plant replacement trees; and how the law deals with encroachment by roots and branches and the wider issues associated with ‘nuisance’ trees.
