Public Law

Tom has experience of acting in public law proceedings and procurement disputes on behalf of a range of clients, and was led by Mark Cawson QC in the Court of Appeal in one of the leading authorities on seeking interim relief against a public body in the case of R. (on the application of the Governing Body of X) v Office for Standards in Education, Children’s Services and Skills [2020] EWCA Civ 594, in which Sir James Eadie QC appeared on behalf of OFSTED.

Tom was sole counsel in the High Court: R. (on the application of X Governing Body) v Office for Standards in Education, Children’s Services and Skills (Ofsted) [2020] EWHC 69 (Admin).

Recent cases in which Tom has been involved includes:

  • R. (on the application of the Governing Body of X) v Office for Standards in Education, Children’s Services and Skills [2020] EWCA Civ 594; R. (on the application of X Governing Body) v Office for Standards in Education, Children’s Services and Skills (Ofsted) [2020] EWHC 69 (Admin).
  • Advising in a dispute between a leading neurological hospital and the Care Quality Commission including as to the merits of an application to obtain an injunction to restrain publication of a damaging report.
  • Acting for the family of a disabled child in a dispute with a primary school, which followed a refusal to accommodate the child in the same school as his sibling, and the subsequent return of the child to the school.
  • Advising on the merits of a procurement challenge following a failure to re-tender a public contract.
