Insolvency

Tanita is predominantly instructed by creditors and insolvency practitioners in matters involving both personal and corporate insolvency. She is experienced at providing advice at the outset of case, drafting Insolvency Act Applications and hybrid Part 7/Insolvency Act claims, and representing clients in the County and High Courts.

Tanita also frequently appears on behalf of creditors or companies/debtors in winding up and bankruptcy lists, and is adept at dealing with unanticipated issues on her feet.

Tanita has particular experience in the following areas:

• Bringing claims against directors involving misfeasance, transactions at an undervalue, and preferences.
• Appearing in hearings related to contested bankruptcy and winding up petitions.
• Representing both creditors and debtors in applications to set aside statutory demands.
• Acting for trustees in bankruptcy in applications for orders for possession and sale under the Insolvency Act 1986 and/or TOLATA 1996.
• Appearing in the High Court Applications List, including in applications to extend administrations and in high value remuneration applications.
• Making remuneration applications on behalf of liquidators, administrators, and trustees in bankruptcy, including applications made out of time and applications to change the basis of remuneration.
