Police Law

Simon has extensive experience in the conduct of claims against the police. Whilst his work covers all aspects of the law including wrongful arrest and false imprisonment his practice leans towards claims for malicious prosecution and misfeasance in public office.

Simon is known for his attention to detail, his marshalling of the facts, his knowledge of the law and his determination when it comes to the ‘fight’.

Police Law Cases

Successful strike out of C’s claim for malicious prosecution. C was able to show that D was not his prosecutor and on the facts as pleaded, C would never be able to prove malice against D.

Represented C, a serving police officer, in his claim for malicious prosecution against his own Chief Constable. Five week trial against Leading Counsel.

Successful representation of C in his claim for wrongful arrest, false imprisonment and malicious prosecution. It was C’s case that there was no evidence against him to support the allegation and the arresting officer had been motivated by his own personal animosity.

Advising C in a claim for malicious prosecution in relation to civil proceedings that had been brought against him by D. D had brought those civil proceedings to discredit C and to harm his career.

Successful representation of C for his arrest and false imprisonment. This was a case of mistaken identity, where C had been arrested simply because he was ‘in the wrong place at the wrong time’. The claim was important to C because he intended to undertake work that would have required an enhanced CRB check.
