Credit Hire

Nia is regularly instructed in credit hire matters on the small claims track and fast track. She often discusses the intricacies of the case with her instructing solicitor including the viability of offers. Nia always keeps an open line of communication with her instructing solicitors to discuss case strategy. • Successfully obtaining the value of the credit hire charges claimed by a pecunious Claimant – Nia calculated that the lowest reasonable Basic Hire Rate (BHR) daily rate exceeded the total credit hire charges. The Judge found that the period of hire was reasonable and awarded the daily rate. The Judge awarded the credit hire charges in full.
• Successfully persuaded the Judge that the period of hire was reasonable
• Successfully persuaded the Judge in a fast track trial where the vehicle was deemed a total loss that the engineering report was useful for the valuation of the vehicle and the assessment of the vehicle – The Judge awarded the engineer fee.
• Successfully persuaded the Judge to grant the Claimant relief from sanctions where the Claimant failed to file and serve documents in compliance with the deadline
• Successfully obtained wasted costs against the Defendant’s solicitors
