David has undertaken personal injury work on behalf of a number of local authorities over many years, including highway claims and employers’ liability claims. He is noted for being client focused and technically superb by solicitors, clients and the legal directories alike.
Recent instructions on behalf of local authorities include the following:
- A successful application, pursuant to Edwards-Tubb v Wetherspoon, for disclosure of a medical report obtained by the claimant prior to the issue of proceedings, where permission had subsequently been granted to rely on the report of a different expert.
- Barker v Lancashire County Council [2013] EWCA Civ 582: The successful defence, under s58 of the Highways Act 1980, of a claim for damages for brain injury sustained due to tripping on a cobblestone raised by tree roots, both at first instance and before the Court of Appeal.
- Negotiating settlement of a claim for a severe knee injury at less than £300,000, where the Schedule of Loss claimed over £1m, after securing significant concessions in cross-examination of the claimant’s medical expert at the trial of a preliminary issue on causation.
