Judicial Review
David is drawing on his 15-year career as a civil servant to develop a judicial review practice advising and representing public authorities. Recent cases include:
- Representing the defendant coroner in an application before the Divisional Court seeking an order for a fresh inquest into a drug related death in the community.
- Representing the defendant public authority in a challenge brought against a “neither confirm nor deny” response to a subject access request, in a case touching upon the interception of communications in prisons.
- Led by Louis Browne KC, a successful defence of a challenge brought against a coroner’s decision on causation and scope in the inquest into the death of Linda O’Brien.
- Led by Louis Browne KC, two successful defences of challenges to decisions made by the Criminal Injuries Compensation Authority
- Led by Louis Browne KC, representing the holder of a shotgun certificate in a judicial review touching on the use of a closed material procedure in firearms appeals.
- Diverse advisory work for local government, in cases ranging from to library bans to the duty to prevent homelessness.
