Kim Whittlestone and Marion Weir secure murder conviction at Carlisle Crown Court

Exchange Chambers’ Kim Whittlestone, leading Marion Weir, has successfully prosecuted a murder trial at Carlisle Crown Court.

Brian Smith, 33, was accused of murdering his 73-year-old father, Stanley Smith, at his home in Cumbria.

The court heard that neighbours reported shouting and loud banging from Stanley Smith’s bungalow on the evening before his body was discovered on 22 December 2025.

The father and son had spent time together earlier that day, visiting the Albion pub to watch football. CCTV captured them returning to Stanley Smith’s address shortly before 20:00, and a neighbour reported hearing a very loud argument about 40 minutes later.

The neighbour said it sounded as though someone was being pushed or shoved and that they telephoned their mother to report what was happening. Towards the end of the call, which lasted almost nine minutes, everything went quiet.

Prosecutor Kim Whittlestone told the jury: “The reason it went quiet was because Stanley Smith was dead, and that he had been murdered by his son.”

The prosecution’s case was that Stanley Smith died following forceful compression of his neck during an argument at his home. The jury heard pathological evidence supporting that conclusion.

On 29 July 2026, the jury unanimously found Smith guilty of murder.

Smith is due to be sentenced on 7 August 2026. Judge Nicholas Barker said that the “inevitable” sentence would be life imprisonment.
