Ian Whitehurst successfully advises client in Insolvency Service investigation

Demonstrating the importance of early strategic advice in regulatory and financial investigations, Ian Whitehurst from Exchange Chambers successfully advised an individual under investigation by the Insolvency Service concerning alleged irregularities arising from business activities within the hospitality sector.
Ian’s advice focused on the nature, extent and timing of pre-interview disclosure, together with the strategic approach to be adopted during interview under caution. Detailed consideration was given to the evidential landscape, potential areas of exposure and the forensic advantages and disadvantages of engagement at each stage of the investigation.
Following implementation of the defence strategy and interview preparation, the Insolvency Service determined that no further action would be taken against the client.
