Employment Tribunal Success for Alfred Weiss

Alfred Weiss from Exchange Chambers has secured an important success for his client in an Employment Tribunal case concerning an allegation of direct age discrimination.

The case required the Employment Tribunal to consider the justification defence namely whether an employer was justified in compulsorily dismissing an employee because they had reached the age of 65.

This area of law is in the process of developing following the abolition of the default retirement age, and the Supreme Court decision in Seldon v Clarkson Wright and Jakes 2012 UKSC 16 SC.

The Claimant, represented by Alfred, was successful in establishing that the reason he was selected for redundancy was because he had reached the age of 65 and that the actions of the employer were not justified.
