David Went to appear in the Supreme Court on Thursday

David Went from Exchange Chambers will appear in the Supreme Court on Thursday (16 February 2023) in a case listed by The Lawyer Magazine as one of its Top 10 appeals of 2023.

The Supreme Court will decide whether litigation funding agreements involving a fixed percentage of recoverable damages are lawful, in a landmark appeal.

The appeal is brought by DAF, one of the five major European truck manufacturing groups found to have breached competition law by the European Commission.

The Dutch manufacturer is facing a collective claim launched by Road Haulage Association, which seeks to recover damages on behalf of purchasers of trucks. The class action was first launched in the Competition Appeal Tribunal (CAT) and is funded by Therium.  David Went, instructed by Backhouse Jones, is part of the counsel team acting for the Road Haulage Association in the collective proceedings and he will be appearing with PJ Kirby KC from Gatehouse Chambers in the Supreme Court on Thursday.

In November 2022, David Went was named as Competition / EU Junior of the Year at the Chambers UK Bar Awards 2022.
