David Sandiford in substantial approved settlement for brain injured Claimant

David Sandiford has recently had a substantial settlement approved in a claim on behalf of a brain injured Claimant.

The Claimant, a young man in his 20s, fell from a significant height sustaining orthopaedic injuries and striking his head on the driveway of the property he was working on. The Claimant’s life changed, he deteriorated and suffered episodes of psychosis. He was ultimately sectioned and remained so at approval. It was the Claimant’s case that he had suffered a traumatic brain injury. The Defendant’s medical experts disagreed and contended that the deterioration was inevitable. There were issues around the Claimant’s capacity, the Defendant contending that the Claimant either had capacity or that capacity was fluctuating.

The Defendant was represented by Leading Counsel. The matter was listed for trial but settled at JSM.

The Claimant can now be helped to put those funds to good use and to ease the burden on those who have cared for him in the most difficult of circumstances’.
