Chris Barnes KC and Tony Goff secure £15.5 million lump sum gross settlement

Chris Barnes KC and Tony Goff from Exchange Chambers, instructed by Romilly Houghton and Sinead Woods at Irvings Law Limited, have secured a £15.5 million lump sum gross settlement for a 40-year-old brain injured Claimant.

The Claimant sustained a severe traumatic brain injury in addition to multiple fractures and internal injuries after being struck and knocked down by a police vehicle.

The police vehemently denied liability but after considerable work and pressure conceded that they were liable to compensate the Claimant for his injuries.

Initially, the doctors at the Major Trauma Centre felt that he was unlikely to survive. At that stage the clinical view was that even if he was to physically recover from his injuries, he would likely remain in a vegetative state with little prospect of recovering any level of awareness.

Despite this, the Claimant made remarkable progress and was finally discharged to a residential neuro rehabilitation unit for intensive therapeutic input over an extended period.

The Claimant’s legal team obtained significant interim payments to fund the purchase of a detached fully adapted state of the art 5-bedroom property to enable the Claimant to return home to his family after his discharge from inpatient residential rehabilitation.

From the outset, they appointed a specialist brain injury case manager to deliver the best possible care to the Claimant and prepared a discharge and transition plan to provide a fully funded private therapeutic and care support package consisting of 2 support staff day and night.

A collaborative approach was adopted throughout to ensure high-quality early rehabilitation and achieve the best possible outcome.

The £15.5 million-pound gross settlement ensures that the Claimant’s future care, accommodation and therapeutic needs will be protected for life, and the Claimant can focus on rebuilding his life surrounded at home by his family.
