Chris Barnes KC and Matthew Stockwell achieve multiple Periodical Payment Orders for a Romanian claimant

Chris Barnes KC and Matthew Stockwell, instructed by Philomena Dagnall of Gregory Abrams Davidson Solicitors, have agreed a settlement for a Romanian claimant injured at birth in the UK. The family has subsequently returned to living in Romania. The settlement, agreed shortly pre-trial and subsequently approved by the Court, may be of interest to other practitioners in the manner in which the various future loss claims were met by way of different PPOs, specifically:

• The future case management costs were to be paid in £ sterling, uplifted annually by reference to ASHE 6115 (80th centile);
• The future care costs were to be paid in Romanian Lei, to be converted to Euros at such a time as Romania joined the Euro, uplifted annually by reference to the Romanian Labour Costs index FOM111C, aggregate.
