Court of Appeal success for Charlotte Noddings

Charlotte Noddings from Exchange Chambers has successfully appealed a sentence of imprisonment imposed for theft offences.  Charlotte persuaded the Court (Carr LJ, Garnham LJ and HHJ Flewitt KC) that the sentence should have been suspended and therefore, the immediate sentence of imprisonment was manifestly excessive.

In October of this year, the defendant was sentenced to 4 months immediate imprisonment for attempting to steal a goat. The case was heard before the Full Court this week to consider leave and the appeal, following an expedited hearing request. The Court of Appeal found that the judge had erred when undertaking the balancing exercise required when considering whether or not a sentence should be suspended.
