Alex Menary Secures Acquittal of Serving Police Officer

Defending at Nottingham Crown Court, Alex Menary from Exchange Chambers has successfully secured the acquittal of a Lincolnshire Police Constable charged with s47 assault.

The assault was alleged to have taken place during the course of the arrest of a detainee who had been tasered during the course of a wider period of disorder. The arrest was captured on a number of body-worn cameras, and concerned the Officer’s use of his baton to strike the detainee whilst handcuffed on the floor.

The Officer maintained the force he had used was reasonable at all times. He was acquitted unanimously.
