Martine also has experience in taxi licensing, benefit frauds, trading standards and environmental offences. Martine particularly enjoys the challenges of the in depth analysis that is required in fraud and money laundering cases.
Recent Notable Cases
• R v Cassell - junior for defence instructed in
£1.6m fraud upon the Department of
Education. Conducted the subsequent
confiscation proceedings involving substantial
hidden assets and overseas accounts.
• R v Mounsey, Beard and Howard - Junior in a large scale prosecution of Vat fraud and money laundering where false companies were set up to evade the vat on the importation over 100 high performance cars. The Proceeds of Crime Act proceedings are still outstanding in which the benefit figure for the main defendant is almost £5m.
• R v Smith (2010) 6 day trial successfully defending a Care worker accused of assaulting a child, fracturing her nose whilst she was in secure accommodation during course of a physical restraint whilst the child was self harming.
• R v Holt (2010) prosecution trial of male oral
rape on a vulnerable adult male.
• R v Williams (2010) successful appeal against sentence following pleas of guilty to 3 robberies one of which involved the use of a weapon.
• R v Felton (2010) prosecution of father accused of s18 upon his 4 week old baby who suffered bilateral skull fractures. This case involves complex medical issues on causation and disclosure applications from the family court.
• R v Toone (2010) defence of man charged with possession of child pornography and extreme pornography likely to cause serious injury to a person’s private parts. This case involved complicated technical expert evidence relating to the computer’s examined, arguments as to far reaching SOPO prohibitions sought by the Crown and questions of dangerousness arising out of other sadistic yet lawful sexual conduct of the Defendant.
• R v Kenna (2010) defence of owner of safe
house in large scale conspiracy to supply
cocaine.
• R v Johnson (2010) prosecution trial 17 year
old alleged of raping 15 year old.
• R v Child (2009) 8 day trial defending a social worker on charges of burglary and fraud against an 84 year old mentally impaired service user. Convicted after trial but awaiting appeal against conviction leave having been granted.
• R v Gerrard & Others (2009) junior for the prosecution in the trial involving the premier football player and his associates.
• R v Johnson (2009) defence a mother on charge of assisting an offender (her son) in an allegation of conspiracy to murder. Suspended sentence received following guilty plea.
• R v Hughes (2007) Defence of resident in a rehabilitation centre who raped another resident whose physically disabilities rendered her incapable of any physical resistance. The case involved complex issues of competency of both the Defendant and the victim. Defendant sentenced to IPP following a guilty plea.
