Lisa Linklater

 

Lisa’s property practice arises predominantly in a security or corporate or personal insolvency context.  In such work, Lisa combines her knowledge and experience of insolvency, lands and trust law and litigation for the benefit of her clients.  She has been regularly recommended by legal directories, Legal 500 and Chambers and Partners, being described as “truly talented and as safe a pair of hands as you could ever hope for”, “technically excellent” and “prized by solicitors for her ‘proactive and collaborative’ approach”.  She was appointed Junior Counsel to the Crown in 2000.

 

Lisa has particular experience of issues relating to Law of Property Act receivers (especially in a “buy to let” investment portfolio context), mortgages, co-owned property, access rights and sale of land in an insolvency context.

 

Recent case-work includes:


P v MP  (2011) (David Steel J) High value claims relating to corporate and personal borrowing in a buy to let portfolio over which LPA receivers had been appointed.


A v L (2010) Acted for purchaser of business (including land) in defending injunction proceedings brought by vendors of business in administration for possession of land and related relief.


W v M & ors (2010) Acted for lender in defence of injunction proceedings brought by borrower in respect of proposed sale of properties within buy-to-let business by LPA receivers.


R v KF (2010) Acted for property developer in professional negligence proceedings against estate agency arising from sale of development.

 

Lisa has additionally advised trustees in bankruptcy in numerous cases in respect of the extent of the bankrupt’s interest in property, issues arising on sale and equity of exoneration arguments.
