Richard’s practice covers work across the commercial and chancery field in general, including:

 

Insolvency – acting both for office holders and those subject to insolvency proceedings in all areas of insolvency including the commencement, continuation and termination of insolvency regimes, transactions at an undervalue, preferences and other insolvency-related misfeasance and asset recovery in the insolvency context.

 

Commercial including general commercial disputes, the sale and supply of goods, contractual disputes

 

Company – all areas of company law, including derivative actions, minority rights, shareholder disputes and directors’ duties

 

Trust Law – including asset tracing, trustees’ rights and obligations and third party liability.

 

Professional Negligence – in general and including solicitors, accountants and other professionals.

 

Notable cases

 

Bank of Scotland v Whiteside (2011) – decision of HHJ Holman regarding the issue of conduct of litigation by non-solicitors.

 

Assisting a firm of solicitors in London in 2008 in relation to disclosure in significant litigation arising out of the Buncefield oil disaster on behalf of a manufacturer of safety systems.
