CASE SUMMARY

Mr Jim W was born on 29th August 1948 and so was 43 when he was injured at work on 24th January 1992. He was 50 at the date of settlement.

Mr W sustained complete paralysis below C4: the management of his condition was complicated by the development of pressure sores requiring substantial further in-patient treatment.

His action was settled in Autumn 1998 for £1,950,000, the offer having been increased by £250,000.00 as a result of the decision of the House of Lords in Wells, Page and Thomas. The Plaintiff's Schedule, which was not agreed by the Defendants, set the claim out as follows:-
