SETTLEMENT REPORT

Tetraplegia
Settlement at £1.7 million (at 55% of full liability)

Mrs C.F. was born in 1955 and so was 41 at the date of the accident in 1996. She was 46 at the date of settlement. She was pushed into a swimming pool and broke her neck.

LIABILITY

1. Agreed at 55%.

QUANTUM

2. The claim was settled without agreement by the Defendant of individual figures. The Claimant is not a patient, and so approval of the court was not required. The figures set out below therefore represent only the opinions of the Claimant's legal advisers as to a reasonable settlement sum. One unusual feature was that the Claimant had bought a nearby, small house to accommodate her carers, thereby protecting her privacy.

3. Life expectancy was significantly reduced, and a multiplier of 17.5 was used.

Pain, suffering and loss of amenity £170,000

interest £9,656

Past losses were in the region of £300,000

Future

care £1,382,320

holidays £67,795

case management £35,000

surgery and hospital admissions £91,238

physiotherapy £34,900

4. There were many other items.

5. The total settlement figure was almost £1.7 million, which represented just over £3 million on full liability.
