Extremely severe brain damage
Settlement at £1.8 million (£1.5 million after deduction of 15% for
contributory negligence)
1. Mr CS was born in 1947 and so was 46 when he was knocked down and injured by
a van in 1994. He was 53 at the date of settlement.
2. The effect of the brain injury was to cause a severe memory defect and a change
in personality, coupled with a lack of drive and loss of organisational and planning
capabilities. He had been a talented pilot, but was now permanently unable to
work.
3. In addition to the brain injury, both legs were broken, and the Claimant suffered
tinnitus and double vision.
4. None of the figures were agreed by the Defendants, but they represent a reasonable
estimate. Only the major figures are set out below.
